1. Service provider

By using Italianicity, you agree to these Terms of Use and the applicable Privacy Policy.

2. Age requirement

You must be at least 18 years old to create an account or use Italianicity.

3. The service

Italianicity is a conversational product dedicated to Italy. It may include Chat, Chapters, Journal, Library, Memory, research/retrieval, Discovery, sharing, export and optional Premium features.

Available features may vary by version, platform, country, account, rollout state or remote configuration.

4. Account

You are responsible for maintaining control of your authentication methods and for promptly contacting us if you believe your account has been compromised.

You must not share credentials or attempt to access accounts, data or capabilities for which you are not authorized.

Italianicity may require fresh identity verification for sensitive actions such as export, account deletion or security management.

5. User content

You retain the rights you hold in content you submit, upload or save in Italianicity.

You must have the rights or permissions needed to provide that content. You must not upload material in violation of law, third-party rights or confidentiality obligations that apply to you.

You authorize ICS Industrial S.r.l. and the technical providers needed to process your content to the extent necessary to provide, secure, maintain and operate the Italianicity capabilities you request, subject to the Privacy Policy.

This permission does not transfer ownership of your content to Italianicity.

6. Artificial intelligence, information and Judgment

Italianicity uses artificial intelligence systems, retrieval and external information sources.

Responses may be incomplete, inaccurate, outdated or may misunderstand a request. The presence of a source does not automatically make an entire response correct.

Italianicity may provide evaluations and recommendations under its own Judgment framework, but external providers do not automatically determine that Judgment and commercial relationships do not buy organic rankings or recommendations.

7. High-impact decisions

Italianicity is not a substitute for a qualified professional.

For legal, medical, financial, tax, safety or other high-impact matters, you should verify information and, where appropriate, consult a qualified professional.

8. Acceptable use

You may use Italianicity for lawful personal purposes consistent with the features made available.

You must not:

• use the service unlawfully;
• infringe third-party rights;
• attempt unauthorized access;
• bypass limits, security controls or entitlements;
• disrupt, overload or interfere with the service;
• distribute malware or content intended to compromise systems;
• use abusive automation, scraping or reverse engineering in violation of applicable law or rights;
• impersonate others or use accounts fraudulently;
• use Italianicity in a way that may materially harm the service, users or third parties.

9. Italianicity intellectual property

The software, brand, design, editorial systems, taxonomies, interfaces, proprietary content and other Italianicity elements remain the property of their respective owners.

These Terms grant you only a personal, limited, revocable, non-exclusive and non-transferable right to use the service according to available features and applicable law.

10. Third-party services and content

Italianicity may use or link to third-party services, sources or content. Those parties may apply their own terms and policies.

Italianicity does not fully control the availability, accuracy or policies of every external service.

11. Paid plans and Stores

When Premium or other paid features are active:

• the price and currency displayed by the applicable Store are the relevant purchase terms;
• purchase, renewal, cancellation, restore, refund and subscription management follow the applicable Store rules;
• Italianicity entitlement is reconciled against the valid state reported by the relevant Store;
• deleting an Italianicity account does not necessarily cancel an active Store subscription.

Any trial or offer is subject to the terms shown in the app and Store when activated.

12. Availability and changes

Italianicity is an evolving product. We may add, modify, suspend or remove features, subject to users’ mandatory rights and any obligations relating to paid services.

Outages, maintenance, provider unavailability or network problems may occur. We do not guarantee uninterrupted availability.

When an external capability is degraded, Italianicity may use a fallback, temporarily limit a feature or inform the user that it is unavailable.

13. Security and suspension

We may restrict or suspend an account when reasonably necessary for:

• security;
• fraud or abuse prevention;
• compliance with law;
• serious or repeated violations of these Terms;
• protection of other users or infrastructure.

Where appropriate, measures will be proportionate and will take account of user access to data and any rights relating to paid services.

14. Account closure

You may request account deletion through available features.

Deletion may require a controlled technical process. Limited data may be retained where required by law or necessary for security, audit, disputes or other legitimate obligations.

15. Disclaimers and liability

Italianicity is provided with the level of care reasonably expected for a digital service of this kind, but it does not guarantee that every AI-generated response will be correct, complete or fit for a particular purpose.

Nothing in these Terms limits or excludes rights or liabilities that cannot lawfully be limited or excluded, including mandatory consumer rights.

To the extent permitted by law, ICS Industrial S.r.l. is not liable for harm resulting from use of the service contrary to these Terms, unreasonable reliance on outputs that required professional verification, or events outside the service’s reasonable control.

16. Privacy

Personal-data processing is governed by the Italianicity Privacy Policy, which forms part of the information governing the relationship with users.

17. Changes to these Terms

We may update these Terms when necessary to reflect changes to the service, law, security or our operating model.

Where a change is materially relevant, it will be communicated appropriately before taking effect where required by law.

18. Governing law and consumers

These Terms are governed by Italian law.

If you are a consumer living in another country, this choice does not deprive you of mandatory protections available under the law of your country of habitual residence where those protections apply.

Any jurisdiction or venue provision applies subject to mandatory consumer-protection rules.
